Notice to Individuals According to Article 13 of the General Data Protection Regulation (GDPR) and Article 76 of the Personal Data Protection Act (ZVOP-2)

REGARDING THE PROCESSING OF PERSONAL DATA THROUGH VIDEO SURVEILLANCE

To ensure the safety and protection of our property and to properly monitor the entry and exit into our business premises, we use a video surveillance system. In accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act (ZVOP-2), we wish to inform you of the following key information:

Purpose of Conducting Video Surveillance:
We carry out video surveillance for the purpose of protecting and safeguarding the company’s property and ensuring the monitoring of entry and exit.

Legal Basis for Processing Personal Data:
Video surveillance is carried out based on legitimate interests, as defined in Article 6(1)(f) of the General Data Protection Regulation.

Explanation of Legitimate Interests:
The purpose of video surveillance is to prevent theft, vandalism, criminal acts, and to protect our property. We also ensure the safety of employees and visitors. The video surveillance system helps us resolve potential incidents and safeguard key information.

Users or Categories of Users of Personal Data, if Any:
Access to archived video footage is granted to authorized individuals within the company, specifically the directors. In the event of an incident, footage preservation is carried out by an authorized external contractor. Footage may also be available to competent state authorities (e.g., police, courts) in certain cases.

Transfer of Personal Data to Third Countries or International Organizations:
Footage is not transferred to third countries or international organizations.

Personal Data Collected Through Video Footage:
Recorded images of individuals (video), location data, date, and time of the recording. Audio is not recorded during video surveillance.

Retention Period of Personal Data:
Footage is stored for 3 months and is automatically deleted afterward. If specific footage is necessary to protect legitimate interests, it is isolated from the collection and stored separately for as long as needed to enforce, pursue, or defend such interests.

Your Rights Regarding Personal Data:
As an individual, you have the right to access, correct, delete, or restrict the processing of your personal data, and the right to object to processing, provided that your requests do not conflict with the purpose of data collection. You can exercise your rights with the data controller.

Is Processing Based on Consent, and Do I Have the Right to Withdraw Consent:
Processing is not based on the individual’s consent but on another legal basis (the controller’s legitimate interest), therefore, the withdrawal of consent is not possible.

Is the Provision of Personal Data a Legal or Contractual Obligation:
No. The provision of personal data is not a contractual obligation or a requirement for entering into a contract.

Must I Provide Personal Data, and What Are the Possible Consequences If I Do Not Provide It:
No, but entry into the business premises and areas under video surveillance is not possible in a manner that avoids video surveillance.

Is Automated Decision-Making or Profiling Performed:
Automated decision-making and/or profiling are not performed.

Unusual Further Processing:

  • No further processing of footage is performed,
  • Audio is not recorded,
  • Video surveillance may be monitored live on a computer screen by an authorized person.
